This site shares educational information about neurotechnology, neurofeedback, and brain health. It does not provide medical or psychological advice or emergency services. All content is owned by Regenesis Neuro and may not be copied or reused without permission. By using this site, you agree to these Terms.

1) Acceptance of Terms

These Terms of Use (the “Terms”) govern your access to and use of the websites, portals, forms, and online services operated by Regenesis Neuro (collectively, the “Site”). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Site.

Inclusive commitment. Regenesis Neuro welcomes people of all backgrounds and identities. We strive to use respectful, inclusive language and to make the Site accessible to as many people as reasonably possible. (see Accessibility Notice, Section 20).

2) Who We Are & Scope of Services

Regenesis Neuro provides information about neurofeedback and related neurotechnologies, along with general wellness education. 

2.1 Non-medical scope. Unless expressly stated in a separate written services agreement, use of this Site does not create a clinician–client, therapist–client, or doctor–patient relationship.
2.2 Independent professionals. Any consulting physician or licensed professional associated with Regenesis Neuro acts as an independent contractor. Regenesis Neuro does not engage in the corporate practice of medicine (Cal. Bus. & Prof. Code §2400).

If we offer products or services for purchase online, additional terms (e.g., consent forms, service agreements, refund policies) may apply and will be presented at checkout or before scheduling.

3) Not Medical or Psychological Advice; Not Emergency Care

Educational use only. All content on the Site is for informational and educational purposes and is not medical or psychological advice, diagnosis, or treatment. Content is not a substitute for professional care. Always seek the advice of a qualified health professional regarding any questions about a condition, safety, or care.

Emergencies. The Site is not an emergency service. If you or someone else is in immediate danger or experiencing a medical or mental‑health emergency, call your local emergency number (e.g., 911 in the U.S.) or go to the nearest emergency department.

4) Eligibility; Children’s Privacy

The Site is intended for individuals 13 years of age or older. If you are under 18, you may use the Site only with the involvement of a parent or legal guardian. Please do not submit personal information about a child without appropriate consent.

We do not knowingly collect, use, or disclose personal information from children under 13 years of age, consistent with the Children’s Online Privacy Protection Act (“COPPA”), 15 U.S.C. § 6501 et seq. If we learn that we have inadvertently collected personal data from a child under 13 without verifiable parental consent, we will promptly delete such information from our systems.

Parental contact. If you believe that a child under 13 (or under 16 in California) has provided personal information to Regenesis Neuro without the appropriate consent, please contact us immediately at info@regenesisneuro.com so we can investigate and delete the data as required by law.

5) Privacy; PHI and HIPAA

Regenesis Neuro complies with applicable privacy laws, including the California Consumer Privacy Act (CCPA/CPRA) and any successor legislation. Unless expressly stated, general website forms and email are not intended for transmitting Protected Health Information (PHI). Do not submit sensitive medical information through unsecured forms.

If Regenesis Neuro acts as a HIPAA-covered entity or business associate for certain services, you will receive or be linked to a Notice of Privacy Practices specific to those services.

6) Intellectual Property; License to Use the Site

All content on the Site—including text, graphics, logos, icons, images, audio/video clips, software, designs, data compilations, and the arrangement thereof—is owned by Regenesis Neuro or its licensors and is protected by intellectual property laws.

We grant you a limited, revocable, non‑exclusive, non‑transferable license to access and make personal, non‑commercial use of the Site, strictly in accordance with these Terms. Except as expressly permitted in writing, you may not:

  • copy, reproduce, modify, adapt, translate, create derivative works of, distribute, publish, display, or perform the Site or its content;

  • use any content for commercial purposes without our prior written consent;

  • remove proprietary notices or circumvent security features; or

  • use the Site, or any portion thereof, for data scraping, extraction, or to train AI/ML models.

7) User Content; Feedback; Testimonials

If you submit comments, reviews, testimonials, questions, or other materials (“User Content”) to the Site, you represent that you own or have the right to share that content and that it is accurate and lawful. By submitting User Content, you grant Regenesis Neuro a worldwide, royalty‑free, perpetual license to host, use, reproduce, display, and create derivative works from such content for Site operation, marketing, and compliance purposes. 

We reserve the right, but are not obligated, to monitor, edit, or remove User Content that we determine violates these Terms or applicable law. Regenesis Neuro is not responsible for User Content posted by others.

Testimonials and individual results. Testimonials or success stories featured on the Site reflect the personal experiences of specific users and are provided for illustrative purposes only. Results and outcomes vary based on many individual factors, and no outcome or experience described should be interpreted as typical or guaranteed. Results vary.

8) Acceptable Use; Prohibited Conduct

You agree not to:

  • use the Site for any unlawful purpose or in violation of applicable laws or regulations;

  • harass, threaten, or discriminate against others; post or transmit content that is hateful, defamatory, obscene, or invasive of privacy;

  • attempt to gain unauthorized access to the Site or related systems;

  • upload viruses, malware, or harmful code;

  • use automated means (including bots, spiders, scrapers) without our express written consent;

  • copy, mirror, or frame the Site; or

  • collect or harvest personal information of others without consent.

We reserve the right to suspend or terminate access for violations.

9) Third‑Party Links & Resources

The Site may link to third‑party websites or resources. Regenesis Neuro does not control, endorse, or assume responsibility for third‑party content, products, or services. Your use of third‑party sites is at your own risk and subject to their terms and policies.

10) Educational and Research References

From time to time, the Site may reference research, publications, or external resources. Such references are provided for education and do not constitute endorsements. Research evolves; new evidence may update or refine understanding.

11) Errors & Omissions; No Warranties

As‑is / as‑available. The Site and its content are provided “as is” and “as available.” Regenesis Neuro makes no warranties, express or implied, regarding accuracy, completeness, timeliness, reliability, merchantability, fitness for a particular purpose, or non‑infringement. We do not warrant that the Site will be uninterrupted, secure, or error‑free, or that defects will be corrected.

Errors & omissions. Information may contain errors or omissions. We disclaim liability for such errors or omissions to the fullest extent permitted by law.

12) Limitation of Liability

To the maximum extent permitted by law, Regenesis Neuro and its officers, directors, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Site—whether based in contract, tort (including negligence), strict liability, or otherwise—even if we have been advised of the possibility of such damages.

If liability cannot be disclaimed, our total liability shall not exceed the greater of: (a) the amount you paid (if any) to access the Site during the six (6) months preceding the event giving rise to the claim, or (b) $100 USD.

13) Indemnification

You agree to indemnify, defend, and hold harmless Regenesis Neuro and its personnel from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or misuse of the Site.

14) Geographic Availability; Regulatory Notes

Services may not be available in all jurisdictions. Neurofeedback and related technologies are subject to evolving regulations; indications, licensing, and permissible claims vary by location and professional scope. Regenesis Neuro does not guarantee service eligibility in your location. We make no claim that content is appropriate or lawful outside the jurisdiction(s) where we operate.

15) DMCA Notice (Copyright Complaints)

If you believe content on the Site infringes your copyright, please send a written notice including: (i) your contact information; (ii) a description of the copyrighted work; (iii) the URL/location of the allegedly infringing material; (iv) a statement that you have a good‑faith belief the use is not authorized; (v) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act; and (vi) your physical or electronic signature. 16) Modifications to the Site or Terms

We may update the Site and these Terms at any time. The “Effective Date” below reflects the latest revision. Continued use of the Site after changes means you accept the updated Terms.

17) Termination

Regenesis Neuro may, at its sole discretion and without prior notice, suspend, restrict, or terminate your access to all or part of the Site or any related services at any time and for any reason, including (without limitation):

  • violation of these Terms or any applicable law or regulation;

  • conduct that, in our reasonable judgment, could harm Regenesis Neuro, its users, or the integrity, security, or operation of the Site;

  • requests by law enforcement or other government authorities;

  • unexpected technical or security issues; or

  • discontinuation or material modification of the Site or any portion thereof.

Upon termination, your right to use the Site immediately ceases. Regenesis Neuro has no obligation to maintain, store, or provide copies of any data or content you submitted, except as required by law.

To the fullest extent permitted by law, Regenesis Neuro and its affiliates shall not be liable for any loss, damages, or inconvenience arising from or related to any suspension, restriction, or termination of access.

Sections that by their nature should survive termination—including but not limited to Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution—shall continue in full force and effect.

18) Force Majeure 

Regenesis Neuro is not responsible for delays or failures caused by events beyond its reasonable control, including natural disasters, power outages, cyber-attacks, or changes in law.

20) Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflicts of law rules. Any dispute shall be resolved in the state or federal courts located in Redondo Beach, CA, and you consent to that venue and jurisdiction.

Any dispute arising from or relating to the Site or these Terms shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, with hearings held in Los Angeles County, California (or by video conference, at the discretion of the arbitrator). You and Regenesis Neuro waive the right to a jury trial, to the extent permitted by law.
